Terms of Service

These Terms of Service apply to the use of the Little Wombats Program website and the booking and delivery of services provided by Little Wombats Program Pty Ltd (“Little Wombats”, “we”, “us” or “our”).

By accessing our website, submitting a booking request or confirming a program, you agree to these Terms of Service and our applicable policies.

1. Our Services

Little Wombats Program provides Aboriginal cultural education experiences for early learning services, schools, holiday programs, community organisations and events.

Program content, activities and delivery may vary depending on the selected program, participant age, location, facilitator, cultural considerations and other relevant circumstances.

2. Booking Requests

Submitting a booking request through our website or booking system does not automatically confirm your booking.

Bookings are subject to facilitator availability, location, program requirements and any applicable travel or accommodation arrangements.

Your booking is confirmed once Little Wombats Program has reviewed and accepted the booking and confirmation has been provided.

3. Group Sizes

Our standard programs cater for groups of up to 30 children.

Where more than 30 children are participating, additional groups may be required.

The number of groups booked should accurately reflect the expected number of participants.

4. Program Duration

Standard programs generally run for approximately 45–60 minutes per group, depending on the program and age group.

Multiple groups may be delivered at the same location where agreed at the time of booking.

5. Pricing

Program pricing is based on the program selected, number of groups, location and any additional services requested.

Any applicable additional travel, accommodation or other agreed costs will be communicated before the booking is confirmed.

Prices may change from time to time. Once a booking has been confirmed at an agreed price, later general price changes will not alter that booking unless the booking itself is subsequently changed.

6. Payment

Invoices must be paid in accordance with the payment terms shown on the invoice and our Payment Policy.

Unless otherwise agreed, payment is due within the applicable payment period or before the scheduled program date, whichever occurs first.

Overdue payments may incur applicable late fees.

7. Rescheduling

Little Wombats Program operates a rescheduling-only policy.

If you are unable to proceed on your scheduled date, your booking may be transferred to another available date in accordance with our Rescheduling Policy.

Confirmed bookings are not cancelled for a refund.

Rescheduled dates remain subject to facilitator availability.

8. Travel

Travel within our standard service areas is generally included in program pricing.

Additional travel, accommodation, flights or other costs may apply for some regional, remote or extended-travel bookings.

9. Changes to a Booking

Please notify Little Wombats Program if there are significant changes to your booking, including:

• Participant numbers
• Number of groups
• Program location
• Program type
• Scheduled times
• Access requirements

Changes may affect program availability or pricing.

Any additional costs resulting from a significant change will be discussed before the updated booking is confirmed.

10. Facilitator Availability

Programs are delivered subject to facilitator availability.

Where a nominated facilitator becomes unavailable due to illness, emergency or other unforeseen circumstances, Little Wombats Program may provide another suitable facilitator or arrange an alternative program date.

11. Safe Program Environment

The school, service or organisation hosting the program remains responsible for the supervision and duty of care of participating children throughout the program.

Little Wombats facilitators do not replace educators, teachers, carers or other supervising adults.

A suitable number of staff members must remain present during the program.

The host organisation is responsible for providing a reasonably safe and appropriate environment for program delivery.

12. Participant Needs

Please advise us before the program of any information reasonably necessary to support safe and appropriate participation.

Where relevant, this may include accessibility requirements, allergies, additional support requirements or other circumstances that could affect participation.

We will make reasonable efforts to accommodate participant needs where possible.

13. Cultural Content & Intellectual Property

Little Wombats Program materials, artwork, program resources, written content, activity materials, photographs, graphics and other original content remain the intellectual property of Little Wombats Program or the relevant rights holder unless otherwise agreed.

Materials provided as part of a program are for their intended educational use.

They must not be reproduced, commercially distributed, modified for commercial purposes or represented as the work of another person or organisation without permission.

This is an important section for you, especially with your artwork and cultural resources.

14. Photography & Media

Little Wombats Program will not rely on a program booking alone as permission to photograph or publish identifiable images of children.

Where photography or media is proposed for promotional purposes, appropriate permission or consent must be obtained.

Schools and services remain responsible for ensuring their own photography, privacy and child-safety requirements are followed.

15. Website Information

We make reasonable efforts to ensure information on our website is accurate and current.

Program descriptions, availability, service areas and pricing may be updated from time to time.

Little Wombats Program may correct errors or update website information where required.

16. Third-Party Services

Our website and business may use third-party services for functions such as website hosting, bookings, payments, communications and accounting.

Use of those services may also be subject to the relevant provider's terms and privacy practices.

17. Liability

Nothing in these Terms is intended to exclude or restrict any rights or remedies that cannot lawfully be excluded under Australian law.

To the extent permitted by law, Little Wombats Program is not responsible for loss arising from circumstances outside our reasonable control.

18. Privacy

Personal information is handled in accordance with our Privacy Policy.

19. Changes to These Terms

Little Wombats Program may update these Terms of Service from time to time.

The current version will be published on our website.

Terms applicable to a confirmed booking will be considered together with the booking confirmation, invoice and policies applicable at the time of booking.

20. Governing Law

These Terms are governed by the laws applicable in Victoria, Australia, subject to any applicable Australian laws.
